In the Matter of the Proceeding Pursuant to Section 44, subdivision 4, of the Judiciary Law in Relation to James P. Gilpatric, a Judge of the Kingston City Court, Ulster County.
On review, the Court of Appeals upheld the Commission's jurisdiction in cases involving "lengthy, inexcusable delays" and remitted this matter to the Commission for further proceedings. Matter of Gilpatric, 13 NY3d 586 (2009). Thereafter, the Commission accepted an Agreed Statement of Facts in which the Administrator of the Commission and Judge Gilpatric stipulated that the judge should be admonished for his delays in rendering decision in 26 cases.
